Depending on your state in the US for a normal 8 hour shift they only have to give you 15 minutes total for smoke brake if a brake at all. I smoke and have had this question asked. Most people use there bathroom brake time to smoke as well.
In my job experiences, if you aren't a smoker, you don't get any breaks except lunch.
At some restaurants, if you are a waiter, you don't even get a lunch break, and you have to beg for a pee break, but the smokers can run off and take a smoke break every hour.
In some, like government, you get two compulsory 15 min tea breaks - one at 10ish and one at 3ish (a set time, not sure when), as well as an hour lunch.
I'm a supervisor in a kitchen and I've always told the guys that even if they dont smoke they can go out for "smoke breaks" too... or tell people you do smoke even if you dont so you can get your 5 min breaks in too.. gotta work with the system
