It's not actually a hate crime to punch a gay person, its only a hate crime if you attacked them for being gay, or if there's reasonable evidence that their being gay can factor into motive. To the contrary of this cry for "social equity" it is an established legal defense quite a few countries including America that assault and murder can occur under "temporary insanity" or diminished capacity for judgment where the victim was gay and sexual advances were perceived to or did occur. This defense has been used as recently as 2011 with success (maybe more recently but that's what I am cite on record) and while not always a "get out of jail free card" has lowered 1st degree murder to second degree or manslaughter, and more. Only two states (California and Illinois) ban this defense as a factor in establishing altered capacity or insanity.
