Yeah, there would have to be a very strong atandard of proof that the person knowingly made a false accusation (I say knowingly specifically in the case of people who report an incident in which someone else was the victim, which introduces a lot more room for misunderstanding)
Indeed. Sadly this also takes incentive away from women who lied to admit that they did - potentially causing men to be locked up and left with the label of rapist their entire lives. It's such a shitty issue all around. People that lie about this stuff are the worst
I used to agree with this...
But then I realised, there are probably tons of cases where rape has happened, but there is no way to prove it accepted in the courts...
My opinion is cloudy since then on this
That’s why the standard for false accusation needs to not be ‘the original accusation was unprovable.’ instead, the incorrect/false accusation has to be provably fraudulent or malicious.
One of the issues with this is that all those stories you read a couple times a year where someone gets un-punished for sexual assault or rape or whatever because the person who accused them admitted they lied would never happen again, not nessesarily because people would stop lying either. There would still be false accusations and, because of the new punishment for lying about it, people would no longer be willing to admit they lied for fear of being punished.
The amount of false accusations is minuscule in comparison to the amount of assaults that happened, and the amount of assaults that go to prosecution is tiny again, and the amount of prosecutions is also small. It's focusing on the wrong issue in all this.
"It's focusing on the wrong issue in all this."
`
Say that again, but to someone who has been falsely accused and been sent to prison for it. Say it to someone who has lost their home, their job, their friends, their family, their reputation.
`
Tell that to the children who had to suffer their parent being called a rapist and an abuser. Who potentially ended up in foster care or with a step-parent who turned out to be a REAL abuser.
`
Or the people falsely convicted of pedophilia who, as we all know, get fucking A-class treatment by their fellow inmates.
`
When the media makes sure everyone knows the accused's name and face in association with being a rapist, but is all but silent if their name is cleared. Hard to unring a bell when you never even try.
`
Please...tell these people again how what they went through... well, it just isn't worth that much, because someone else somewhere in the world was the victim of a crime that had nothing to do with the person being falsely accused.
Tell them how their suffering and what they've lost Is a goddamn DISTRACTION from the REAL issue.
`
Nevermind that the falsely accused are literally the victims of a crime themselves.
`
Nevermind that false accusations hurt not only the accused, but also victims of real assaults -- who now have to fight thrice as hard to be believed because some piece of garbage decided to lie about something so horrible.
`
Children who can't get the help they need because some horrible person wanted to win their custody dispute so badly, they stole another child's story and pain, and forced their own child to regurgitate it in front of the entire world. And the children IN those disputes, who have to live with the consequences of a part they were forced to play.
`
What a fucking thing to say.
`
The only thing that happens when we minimize the trauma and minimize the focus on people who have suffered unjustly is they are silenced. And we end up with even more victims. And more criminals walking free.
